TERMS

1. All submitters to Hollywood Hitmaker both imply and agree to participate and obey the rules by their participation in the challenge.

2. All submission gains must be accepted as awarded. Submission gains are non-exchangeable, non-transferable, and are not redeemable for cash or anything else. Hollywood Hitmaker retains the right to substitute a submission gain with something else in the event the original mentioned gift offered is not available due to circumstances beyond Hollywood Hitmaker's control.

3. All submission gains will be presented to the chosen one in person at "The Ivy" - unless otherwise noted.

4. Inability of submitters to accept the submission gains will result in forfeiture. Certain submission gains may require the receiver to be 18 years of age or older, or have signed permission of parent or legal guardian to accept the submission gain.

5. Employees of Hollywood Hitmaker, its affiliated companies, their advertising agencies, and immediate families are eligible to submit and be chosen.

6. No chosen challenger may represent, or appear in any advertisement for any other "talent show-based" shows in America, other than Hollywood Hitmaker for a period of 1 (one) year from the day he/she is deemed better than Brett. Additionally, no submission gain may be used in any way that would have, or could have been expected to have an adverse or negative effect on Hollywood Hitmaker.

7. If the submission gain includes travel, accommodation, entertainment, or a special event, receiver is responsible for all taxes, expenses, and gratuities not expressly included in and as part of the prize. Submission gain receiver agrees to accept all blackout dates, space availability requirements, etc. established by Hollywood Hitmaker's submission gain partner(s), such as hotels, airlines, trains, ships, etc. Submitter agrees that acceptance of any trip taken as a gift does so entirely upon their own initiative, risk, and responsibility. If the trip requires traveling outside of the United States, the receiver, upon receiving the submission gain, must have a valid US passport. If the submitter does not have a valid US passport upon receiving the submission gain, the trip may be forfeited.

8. Submitter will permit Hollywood Hitmaker use their name, voice and/or likeness without prior notice or compensation, for promotional purposes in connection with the challenge in either broadcast or print forms.

9. The chosen one is responsible for all costs associated with travel to any venue or event for which a gift was given, unless otherwise specified.

10. No purchase necessary.

11. Submitter shall solely be responsible for all applicable taxes or additional charges on any submission gain received.

12. Hollywood Hitmaker will require proof of submitter's age before anything can be sent to them. Receipt of submission gain may be delayed until such proof is received by Hollywood Hitmaker and failure to do so will negate any claim. Submission gains will be mailed/available for pickup 6-8 weeks after they have been awarded, unless otherwise noted.

13. The chosen one agrees to indemnify and hold forever harmless Hollywood Hitmaker, promotion agencies, their agents, officers, employees, affiliates and assigns for any injuries, accidents, misfortunes, or causes of action arising from or in connection with their video, submission process and/or acceptance of a reward.

14. A group or band can enter. Any ties, disputes, conflicts, questions or concerns regarding Hollywood Hitmaker and/or their associated submission benefit will be handled by the Hollywood Hitmaker Marketing and Promotions Department, whose decisions are final and indisputable.

15. I agree to indemnify and to hold Hollywood Hitmaker, it's affiliated and parent companies harmless in the event of any injuries or other maladies with regards to participation or submission in anything staged or sponsored by Hollywood Hitmaker. I have recorded and submitted a video at my own risk, and agree to hold nobody responsible for any injuries or misfortune with regards to participation in any Hollywood Hitmaker related thing.

16. If concert or other ticketed event has been given as a submission gain and the concert or event is postponed, rained out, cancelled, or for other reasons beyond our control does not occur, Hollywood Hitmaker will not be responsible for replacing whatever it was you got.

17. Submission gain subject to regulations and laws and is void where restricted or prohibited by law. Upon receiving anything from Hollywood Hitmaker, the submitter is no longer eligible to get anything (email excluded) from Hollywood Hitmaker within a thirty (30) day period following the initial thing.

18. Upon receiving a submission gain valued at $500 or more or getting a trip, the household may not get a second trip or submission gain valued at $500 or more within a one (1) year period following the first one.

19. Submitters must use their true, legal name when playing music or attempting to claim reward and may not do any of this under an assumed name. Submitter will be disqualified and submission gain(s) forfeited if they are found playing under an assumed name or alias.

20. Hollywood Hitmaker is not responsible for any disconnection of a participant's video file upload due to local or long distance phone company's failure, power company failure, or other acts of God.

21. Hollywood Hitmaker retains the right to amend these rules and regulations at any time for any reason.

22. The final decision on who is chosen is made by Brett Meisner.

23. Hollywood Hitmaker has zero obligation to award anything at all as there are no entry fees.

24. Users are submitting their video files for free and for the purpose of entertainment.
